As regards trade marks my Committee are not able to see,
at present, why, if all the assets of a business here are sold, the trade marks should not be sold with it especially as any sale of the goodwill is out of the question since these firms under existing circumstances, have no local goodwill. The value of the trade mark would appear to be only in so far as its use in the Colony is con- -cerned since the mark would continue to be used in China from Canton or Shanghai. They should be sold where creditors exist for any value they would fetch and, if unsaleable should be expunged fror the register and unrestricted liberty to use them should be given to other firms. Liquidators even of insolvent German firms have been instructed to pay renewal fees, to the Goverment. Why should creditors money be used for this purpose ↑
My Committee think it will be recognised that the steps bove advocated do not, in any sense, amount to an invasion of private rights. Rather may it be said that the existing position, by forbidding the use of the usual machinery for the recovery of debts,
